This website is owned and operated by Evolution of Style Custom Clothiers, Inc. (“Evolution of Style”). Accessing the Site will constitute your acceptance of these terms of use. Please do not enter the Site if you do not agree to abide by these terms.
We reserve the right to change the nature of this relationship at any time and to revise these Terms of Use from time to time as we see fit. As such, you should check these Terms of Use periodically. Your accessing, viewing, browsing and/or using the Site after we post changes to these Terms of Use constitutes your acceptance and agreement to those changes, whether or not you actually reviewed them. Additional terms and conditions may apply to purchases of goods or services and to specific portions or features of the Site, including contests, promotions, the Flawless Fit Promise, or other similar features, all of which terms are made a part of these Terms of Use by this reference. You agree to abide by such other terms and conditions including, where applicable, representing that you are of sufficient legal age to use or participate in such service or feature. If there is a conflict between these Terms of Use and the terms posted for or applicable to a specific portion of the Site or for any service offered on or through the Site, the specific terms for that portion of the website shall control with respect to your use of that portion of the Site or the specific service.
Evolution of Style’s obligations, if any, with regard to its products and services are governed solely by the agreements pursuant to which they are provided, and nothing on this Site should be construed to alter such agreements.
Evolution of Style may make changes to any products or services offered on the Site, or to the applicable prices for any such products or services, at any time, without notice. The materials on the Site with respect to products and services may be out of date, and Evolution of Style makes no commitment to update the materials on the Site with respect to such products and services.
Evolution of Style reserves the right to make an additional charge or charges to your account based on violations of its Remakes policy. The Remakes policy requires you to return the original item purchased within 30 days of the successful submission of a remake application. Violations of the Remake policy can result in an additional charge for the remake item at its then current full retail value including any applicable taxes. Failure on the part of Evolution of Style to make any additional charges to your account does not release you from your responsibility to return the original item.
Each of these policies may be changed from time to time and are effective immediately upon posting such changes on the Site.
Accounts, Passwords and Security
Certain features or services offered on or through the Site may require you to open an Account (including setting up a Evolution of Style username and password). In consideration of your use of the Site, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You also agree to provide true, accurate, current and complete information about yourself as prompted by the Site’s registration form. If you provide any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or Evolution of Style has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Evolution of Style has the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof). You are entirely responsible for any and all activity that occurs under your account as a result of your failing to keep this information secure and confidential. Because of this, we strongly recommend that you exit from your account at the end of each session. You agree to notify Evolution of Style immediately of any unauthorized use of your account or password, or any other breach of security. You may be held liable for losses incurred by Evolution of Style or other third parties as a result of someone else using your Evolution of Style username, password or account.
You may not use anyone else’s Evolution of Style username, password or account at any time without the express permission and consent of the holder of that username, password or account. Evolution of Style cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.
